§ 1. General Provisions

1. The seller of products offered on kotlyspa.eu is the owner of the website, hereinafter referred to as the "Seller".

2. The buyer may be a natural person with full legal capacity, a legal entity, or an organisational unit without legal personality, hereinafter referred to as the "Buyer".

3. The Seller can be contacted via:

§ 2. Products & Offer

1. The subject of sale are cast-iron SPA cauldrons manufactured by KotlySPA, available in the following models:

• Standard Cauldron Ø200 – capacity 1,500 l, for 4–6 persons, price from EUR 4,100 net
• Grande Cauldron Ø249 – capacity 2,000 l, for 6–10 persons, price from EUR 6,100 net

2. All prices listed on the website are net prices and do not include VAT. VAT is calculated in accordance with the regulations applicable in the country of delivery.

3. Shipping and installation costs are quoted individually and are not included in the product price. A quote is provided once the Buyer supplies the delivery address.

4. Product photographs are for illustrative purposes. The Seller reserves the right to minor visual differences resulting from the handcrafted nature of production.

§ 3. Placing Orders

1. Orders can only be placed on an individual basis — via the contact form, email, or telephone.

2. An order is placed after the following steps are completed:

• The Buyer submits an enquiry specifying the model, delivery address, and any individual requirements.
• The Buyer receives an individual quotation from the Seller.
• The Buyer confirms acceptance of the quotation in writing (by email).
• The Buyer pays the agreed deposit.

3. The sales contract is concluded at the moment the Seller confirms acceptance of the order by email.

§ 4. Payments

1. The Seller accepts the following payment methods:

• Bank transfer based on a pro forma invoice
• Other payment methods agreed individually

2. Standard payment terms:

• Deposit: 50% of the net order value upon order placement
• Remaining amount: 50% before dispatch, after confirmation of readiness for delivery

3. Production begins once the deposit has been credited to the Seller's account.

§ 5. Lead Times & Delivery

1. The standard production and delivery lead time is 2–4 weeks from the date the deposit is credited, unless individual arrangements provide otherwise.

2. Due to the weight of the cauldrons (1,200–1,950 kg), delivery is carried out by specialist heavy transport. Logistics details are agreed individually.

3. The Seller ships to Poland, the Czech Republic, Slovakia, Germany, and other European countries — subject to prior agreement on terms and costs.

4. The risk of accidental loss or damage to the product passes to the Buyer upon receipt of the goods.

5. The Buyer is responsible for providing adequate access and space for unloading.

§ 6. Warranty

1. KotlySPA provides a 5-year warranty on the cauldron body from the date of receipt, provided the operating instructions are followed.

2. The warranty covers material and manufacturing defects of the cast-iron body.

3. The warranty does not cover:

• Damage resulting from improper use or maintenance
• Normal wear and tear resulting from use
• Damage caused by external factors (frost, impact, etc.)
• Wooden elements and additional accessories
• Surface corrosion resulting from lack of proper maintenance

4. Warranty claims must be submitted by email to kontakt@kotlyspa.eu with a description of the defect and photographic documentation.

§ 7. Complaints

1. The Buyer has the right to file a complaint if a product defect is found within 14 days of the date of receipt.

2. Complaints must be submitted in writing to kontakt@kotlyspa.eu, including:

• Order number and date of receipt
• Description of the defect found
• Photographic documentation of the defect

3. The Seller processes complaints within 14 business days of receipt.

4. In the case of a justified complaint, the Seller will, at its own discretion, repair the product, replace it with a defect-free item, or refund the purchase price.

§ 8. Right of Withdrawal

1. As each SPA cauldron is a product manufactured to the Buyer's individual specifications, the right of withdrawal without giving reasons does not apply (pursuant to applicable consumer protection law regarding custom-made goods).

2. Cancellation of an order is only possible before production begins. In such a case, the Seller refunds the deposit paid, less any documented costs incurred up to the point of cancellation.

§ 9. Data Protection

Personal data of Buyers is processed in accordance with the Privacy Policy available at privacy-en.html and in compliance with GDPR regulations.

§ 10. Final Provisions

1. Matters not regulated by these Terms & Conditions are governed by applicable Polish law, in particular the Civil Code and the Consumer Rights Act.

2. Any disputes arising from orders shall first be resolved amicably. Failing that, disputes shall be settled by the competent common court.

3. The Seller reserves the right to amend these Terms & Conditions. Amendments take effect upon publication of the updated version on the website. Orders placed before the change are fulfilled under the terms applicable at the time of placement.

4. These Terms & Conditions are effective from 1 April 2025.
